PERSONAL DATA PROCESSING INFORMATION document pursuant to art. 13 of Legislative Decree no. 196 of 30 June 2003

This information document refers to the “www.guber.it” site (hereinafter, the “Site”), owned and managed by Guber S.p.A., having its registered office in Brescia, Via Corfù no. 22 (hereinafter, “Guber” or the “Company”), in its capacity as Data Controller, and not to other websites visited by linking.
This information document is addressed to any person and entities utilising the web Site pages, both those who utilise the Site without registering, and those who at the end of a specific procedure register with the Site and utilize the on line information services it offers.
The information hereunder is provided pursuant to art. 13 of Legislative Decree no. 196/2003, as well as Recommendation no. 2/2001 on certain minimum requirements for collecting personal data on line adopted on 17 May 2001 by the Personal Data Protection European authorities joined in the working party established by art. 29 of Directive no. 95/46/EC.
Browsing
No personal data are required for access to the Site.
However, the IT systems and software required for Site operation request some personal data when utilized, of which transmission is implied in the use of Internet communication protocols.
Such information is not collected to be associated to data subjects who have been identified, but due to their nature may lead to user identification through processing or association.
This category includes IP addresses or domain names of the computers utilised by the users connecting to the Site, the Url addresses of the resources requested, the time of the request, the method utilized to submit the request to the server, the size of the file obtained in reply etc.
These data are only used to gather statistical anonymous information on the use of the Site (such as the number of visits) and check its correct operation, and are removed immediately after processing.
No directly identifying information is utilised in this process.
No cookies for the transmission of personal information, persistent cookies of any kind or user tracking systems are utilized.
The use of session cookies (that are not persistently stored in the user’s computer and vanish when the browser is closed) is strictly limited to the transmission of session identification data (server-generated casual numbers) necessary to allow a safe and efficient browsing of the Site.
Registration
The information and data requested in the event of registration shall be utilised to provide, further to express request, information about the services offered by Guber.
The personal data of the registered users shall be processed for the purposes and in the manner specified in this information document.
PRIVACY INFORMATION NOTE pursuant to art. 13 of Legislative Decree 196/2003
Registration with the Site owned and managed by Guber S.p.A. and any further use of the information services rendered by Guber through the Site will involve the processing of your personal data which you are providing or will provide us with.
Therefore, in accordance with Legislative Decree no. 196. of 30/06/2003 (the “Personal Data Protection Code”), we hereby inform you that the Company, in its capacity as owner of the Site and Data Controller, will process the personal data regarding you under the following conditions.
Art. 1. Processing purposes
Personal data processing (including their registration with the Company’s name lists) is carried out exclusively for the following purposes:
- to ensure the exact performance of the information services asked to Guber and therefore to fulfil properly and timely the obligations arising out of the contractual relationships concluded with you as well as the obligations deriving from the current law or regulations, with specific reference to tax and public order matters;
- for administrative and accounting purposes.
Art. 2. Provision of data and consequences if you deny consent to data processing
Although the provision of data for registration with the Site is voluntary, it is necessary to gain access to the information services supplied by Guber through the Site.
Therefore, request of information services implies your consent to processing of personal data regarding you for the purpose of performance of the contractual relationship and for administrative and accounting purposes as specified under art. 1 (a) and (b) above.
Subject to the above, it is understood that if you deny consent to the processing of your personal data, our Company with not be able to supply you with the information services required, and may in any case utilise your data solely for the purposes of proper satisfaction of the legally prescribed obligations.
Your consent to data processing for one or more of the purposes mentioned above may be revoked each time sending a request to the following e-mail account: d.olivini@guber.it.
Art. 3. Processing methodologies
Your personal data processing will mainly be carried out by electronic or in any case automated means, utilising methods and tools adequate to ensure safety and confidentiality in accordance with Legislative Decree 196/2003.
Specifically, all technical, IT, logistic and procedural safety measures provided for by Legislative Decree 196/2003 will be adopted to ensure the minimum data protection level provided for by the law, granting access only to the entities in charge of processing appointed by the Data Controller or the Data Processors designated by the Data Controller.
The information gathered and the processing method will be relevant to and not excessive in relation to the type of services rendered.
Data will be handled and protected in environments to which access is constantly monitored.
Art. 4. Data communication and spreading
Your data may be communicated:
- to all entities (including public authorities) who have access to personal data pursuant to laws or regulations;
- companies, advisors or professionals to whom the installation, maintenance, updating and management in general of Guber’s hardware and software are assigned or which are utilized by the Company to provide its services;
- all public and/or private entities, individuals and/or legal persons (legal, administrative and tax consultancy firms, judicial authorities, chambers of commerce, Employment and Labour offices etc.), if the communication is necessary or functional to the correct performance of the contractual obligations entered into and the legally prescribed obligations.
Your personal data will not be spread.
Art. 5. Personal Data Controller and Personal Data Processor
Guber S.p.A., having its registered office in Brescia, Via Corfù 102, is the Personal Data Controller.
The Personal Data Processor within the meaning of art. 29 of Legislative Decree 196/2003 is the IT Director currently in charge, resident at the Data Controller’s registered office in Brescia, Via Corfù n. 102.
All claims and requests related to the processing of personal data regarding you may be submitted to the above-mentioned Personal Data Controller or the Personal Data Processor at the following addresses:

Art. 6. Storage of personal data
Your personal data will be stored only for the period of time required to ensure a correct provision of the information services offered by our Company.
Your data will be stored for administrative purposes for a period of time not exceeding a quarter, subject to specific legal obligations regarding the keeping of accounting documents or public order. In such cases, data erasure will be ensured also by any third parties to whom they may have been communicated.
Art. 7. Right of access to personal data
Pursuant to art. 7 of Legislative Decree 196/2003, you will have the right to:
a) obtain confirmation as to whether or not personal data concerning you exist, and communication of such data in intelligible form;
b) obtain from the Data Controller or the Data Processor:
- information on the source of the personal data, on the processing purposes and methods, on the logic applied to the processing if the latter is carried out with the help of electronic means;
- identification data concerning Data Controller, Data Processors and, if it is the case, the representative designated by a foreign entity for data processing in Italy;
- information on the entities or categories of entities to whom or which data may be communicated or who or which may get to know said data in their capacity as designated representative in the territory of the State, Data Processors or persons in charge of the processing;
c) obtain:
- updating, rectification or integration of the data relating to you;
- erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is necessary for the purposes for which they have been collected or subsequently processed;
- certification to the effect that the operations as per the letters above have been notified as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;
d) object in whole or in part:
- on legitimate grounds, to the processing of personal data concerning you, even though they are relevant to the purpose of the collection;
- to the processing of personal data concerning you, where it is carried out for the purpose of sending advertising material or direct selling or else for the performance of market surveys or commercial communications.
